In the State of Texas, it is unlawful for anyone to sell, loan, rent or give a handgun to another person whom the seller knows has the intention to use it unlawfully. You may not sell, loan, rent or give a handgun to any person under the age of 18 unless you have the written consent of his or her parent or guardian. It is also illegal to knowingly or recklessly sell a firearm or ammunition to an intoxicated person.
Other illegal weapons that you may not sell, loan, rent or give to another includes machine guns, zip guns, a rifle with a barrel that is less than 16 inches with an overall length less than 26 inches, or a shotgun that has a barrel shorter than 18 inches and an overall length that is less than 26 inches.
The laws concerning the illegal sale of a weapon change frequently, and this is not a complete list of weapons that are illegal to sell. If you have questions or need legal advice concerning this issue, call our office.
